End User License Agreement for Flow Arts Meetup
1. Agreement to Terms
By accessing or using Flow Arts Meetup ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App. These terms constitute a legally binding agreement between you and Flow Arts Meetup (owned by Ty Roachford).
2. Use of the App
Flow Arts Meetup is a community platform designed to connect flow artists worldwide. You agree to use the App only for lawful purposes and in accordance with these Terms.
You must be at least 18 years old to use the App. By using the App, you represent and warrant that you meet this age requirement.
3. Account Registration
To access certain features of the App, you must create an account. You agree to:
- •Provide accurate and complete information during registration
- •Maintain the security and confidentiality of your account credentials
- •Notify us immediately of any unauthorized access to your account
- •Be responsible for all activities that occur under your account
4. Subscriptions & Auto-Renewable Subscriptions
Flow Arts Meetup offers optional premium features through auto-renewable subscriptions managed through the Apple App Store or Google Play Store.
Subscription Terms:
- •Payment: Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
- •Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24-hours before the end of the current period.
- •Renewal Charge: Your account will be charged for renewal within 24-hours prior to the end of the current period at the same rate.
- •Management: You can manage and cancel subscriptions in your App Store or Google Play account settings.
- •Free Trial: Any unused portion of a free trial period will be forfeited when purchasing a subscription.
Subscription prices and available plans are displayed in the App. Prices may vary by region and are subject to change.
5. User Content
You retain ownership of content you post on the App. By posting content, you grant Flow Arts Meetup a non-exclusive, royalty-free license to use, display, and distribute your content within the App.
You agree not to post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable. We reserve the right to remove any content that violates these terms.
6. Prohibited Conduct
When using Flow Arts Meetup, you agree NOT to:
- •Violate any applicable laws or regulations
- •Impersonate any person or entity
- •Harass, threaten, or intimidate other users
- •Upload viruses or malicious code
- •Attempt to gain unauthorized access to the App or other users' accounts
- •Use the App for commercial purposes without our written consent
7. Marketplace Terms
Flow Arts Meetup includes a marketplace where vendors can sell products. When purchasing from vendors:
- •Transactions are between you and the vendor directly
- •Flow Arts Meetup facilitates the platform but is not party to vendor transactions
- •Vendors are responsible for their products, shipping, and customer service
- •Refund policies are determined by individual vendors
7.1. Vendor Responsibilities and Fees
Vendors who sell products through the Flow Arts Meetup marketplace agree to the following:
- •Vendors are responsible for accurately describing their products, setting prices, managing inventory, and fulfilling orders
- •Vendors must provide timely customer service and handle returns, refunds, and disputes according to their stated policies
- •Vendors must comply with all applicable laws and regulations regarding their products and business operations
- •Platform Commission: Flow Arts Meetup charges a commission fee of 6% of the transaction amount plus $0.50 per transaction. This commission is automatically deducted from each sale before funds are transferred to the vendor. Additionally, Stripe payment processing fees (approximately 2.9% + $0.30 per transaction) are deducted from the transaction amount. For example, on a $100 sale: Flow Arts Meetup's commission is $6.50 ($6.00 + $0.50), Stripe's processing fee is approximately $3.20 (2.9% + $0.30), and the vendor receives approximately $90.30.
- •Commission rates may be updated from time to time, and vendors will be notified of any changes
8. Intellectual Property
The App, including its design, features, and content (excluding user-generated content), is owned by Flow Arts Meetup and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our written permission.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLOW ARTS MEETUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE.
11. Termination
We may terminate or suspend your account and access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
12. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through the App. Your continued use of the App after such changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
